These Terms of Service define the service, liability, and operating standards for all moves completed by Hustle X Moving Inc. and apply to every customer engagement unless superseded by a written agreement.
1. Carrier Liability Scope
Hustle X Moving Inc. is responsible for loss or physical damage to goods only when caused by our direct negligence. Liability is limited to the provisions below.
2. Exclusions from Liability
a) We are not responsible for loss, damage, or delays arising from unavoidable or external events, including but not limited to: natural disasters, civil disturbances, labour disruptions, inherent defects in items, customer handling, legal authority actions, quarantine events, equipment failure, or extreme weather.
b) We do not assume responsibility for:
- Fragile items (glass, stoneware, mirrors, artwork, etc.) unless professionally packed by Hustle X.
- Electronics or appliances unless serviced or disconnected by us.
- Missing contents from customer-packed boxes unless we inspected and sealed them prior to the move.
3. Valuation Basis
Liability is tied to the fair market value of the item at the time and location of pickup unless the customer declares a lower value in writing or an alternate valuation structure is agreed upon.
4. Maximum Liability Framework
If an item is deemed non-repairable or repair is not commercially reasonable, Hustle X’s maximum liability is $6.00 per pound, calculated using the item’s actual weight.
Hustle X may choose to retain the damaged item for salvage value recovery, but is not obligated to do so.
This cap does not apply to cosmetic or minor damage (scratches, surface wear, minor dents). Those items fall under the Appearance Allowance outlined in Section 31.
All claim outcomes follow a reasonability standard based on age, condition, and market value. If the weight-based amount exceeds realistic value, compensation may be adjusted accordingly with explanation.
Hustle X Moving Inc. does not offer full-value replacement coverage. Customers with high-value items should secure third-party insurance before the move.
5. Consignor’s Risk
When mutually agreed, the customer may accept responsibility for specific items or conditions that fall outside our control.
6. Notice of Claim
All claims must be submitted in writing within 24 hours of delivery. Hustle X will confirm receipt within 7 days and begin review.
7. Items of Extraordinary Value
Hustle X Moving is not responsible for loss or damage involving jewelry, cash, documents, collectibles, or other high-value goods unless covered by a documented special-handling agreement.
8. Prohibited / Hazardous Materials
Hazardous or restricted materials must not be shipped. Failure to disclose may result in the customer assuming full liability for resulting damages, delays, or costs.
9. Payment Requirements
All outstanding balances must be paid in full prior to unloading. Accepted payment methods:
Visa, MasterCard, E-Transfer, Certified Bank Draft, or approved corporate billing.
10. Packing Requirements
Mattresses and box springs must be fully bagged.
Flat-screen TVs must be transported in either their original manufacturer packaging or a TV box purchased from Hustle X.
All other furniture will be wrapped using Hustle X professional moving blankets and protective materials.
11. Mechanical Condition Policy
We do not cover internal mechanical, electrical, or operational failures of appliances or electronics unless accompanied by visible external impact damage caused by Hustle X. Electronics exposed to extreme temperatures may require 24 hours to acclimate before use.
12. Property Damage Limitation
Liability for damage to customer property (floors, railings, walls, doors, etc.) is capped at $500 per address.
13. Particle Board / Flat-Pack Furniture
All particle board, MDF, pressboard, and flat-pack furniture moves at full owner’s risk. These items are not designed for transport once assembled.
14. Non-Permitted Items
Plants, liquids, hazardous chemicals, perishable goods, and battery-operated devices may not be eligible for coverage.
15. Storage Terms
If storage services are provided, additional terms apply under the Hustle X Storage Policy.
16. Cancellation Terms
Cancellations after booking are subject to a $100 + GST administration charge.
17. Additional Service Requests
Add-ons (assembly, extra labor, handling specialty items, long carries, shuttles, etc.) may carry incremental fees and must be approved before execution.
18. Date Change Policy
Rescheduling is subject to availability. No fee applies unless external costs have already been incurred.
19. Dispute Resolution
Any disputes will fall under the jurisdiction of the Province of British Columbia. If a subcontracted partner completes the job, jurisdiction may align with their operating region.
20. Mysterious Disappearance
Hustle X will not assume responsibility for items that cannot be verified as loaded or unloaded. Customers should maintain their own item inventory and insure high-value goods.
21. Flat-Rate Projects
Quoted flat rates stand unless the job scope materially changes (access issues, added inventory, undisclosed heavy items, delays caused by the customer, etc.).
22. Delays & Storage-In-Transit
Delays outside our control (elevator, keys, access issues, weather, traffic, customer packing delays) may incur storage-in-transit or wait-time charges.
23. Third-Party Service Disclaimer
Hustle X is not responsible for the performance or damages caused by third-party vendors such as cleaners, contractors, appliance technicians, or storage facilities.
24. Customer Obligations
The customer or an authorized representative must be present at both pickup and delivery unless pre-approved otherwise. Parking, elevator reservations, and access arrangements must be secured in advance.
25. Disclosure of Specialty Items
Customers must declare oversized, heavy, or complex items (pianos, safes, hot tubs, commercial equipment, etc.) in advance to ensure proper equipment and staffing.
26. Parking & Access Costs
Customers are responsible for any parking fees, permits, or fines incurred during the move.
27. Force Majeure
Hustle X is not liable for delays or damages resulting from events beyond reasonable control (public emergencies, pandemics, transportation shutdowns, etc.).
28. Right to Decline Service
We may refuse or stop service if conditions are unsafe, unlawful, or abusive toward staff.
29. Agreement Validity
Only written agreements are binding. Email confirmations, signed quotes, and digital authorizations are enforceable.
30. Crib Disassembly Policy
For safety and compliance reasons, Hustle X does not disassemble or assemble baby cribs. Customers are responsible for all crib-related setup.
31. Appearance Allowance
For cosmetic damage to still-functional items, Hustle X may offer up to $50 per item as full and final settlement. This is not negotiable and does not represent replacement value.
32. Flat-Screen TV Handling
TVs will only be moved if:
- Packed in original packaging with foam inserts, or
- Packed in a Hustle X TV box purchased on-site.
Unpacked TVs will not be transported. Hustle X may plug in and test TVs before or after packing to confirm operational status.
33. Policy Updates
Hustle X reserves the right to modify these Terms of Service at any time. The most current version will be available on our website. Customers are responsible for reviewing terms prior to their move.
By hiring Hustle X Moving Inc., the customer acknowledges and agrees to all terms stated above.
